Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Right To Try LLC, doing business as GetMyIVM ("GetMyIVM," "we," "us"). By creating an account, completing intake, placing an order, or otherwise using the GetMyIVM website, applications, or services (together, the "Platform"), you agree to these Terms, our Privacy Policy, our Notice of Privacy Practices, and the consents you accept during intake.

If you do not agree, do not use the Platform. You must be at least 18 years old and physically located in a U.S. state where GetMyIVM operates.

1. What GetMyIVM is — and is not

Right To Try LLC operates the GetMyIVM Platform, which provides the technology, intake, scheduling, messaging, and care-coordination tools through which independent licensed physicians review your health information and, when they determine it is appropriate, issue prescriptions. GetMyIVM is not a pharmacy and does not dispense medication. Any prescription is filled and shipped by an independent licensed pharmacy.

Clinical decisions are made only by a licensed physician. GetMyIVM uses software, including artificial-intelligence tools, to organize and summarize intake information for the physician, but the physician makes every clinical decision and is responsible for your care. GetMyIVM does not guarantee any diagnosis, prescription, or outcome. Using the Platform does not, by itself, create a physician–patient relationship; that relationship is formed only if and when a physician accepts you into care.

Compounded preparations are not FDA-approved. We make no claim that any medication treats, cures, or prevents any disease. A licensed physician determines whether any prescription is appropriate and safe for you based on your individual health information and your informed consent. GetMyIVM makes no claims regarding any non-FDA-approved use. Any decision about whether a medication is appropriate for you is made solely by an independent licensed physician after reviewing your individual information and discussing the available evidence, risks, benefits, and alternatives with you. A physician may prescribe a medication for a use other than its FDA-approved indication only after individualized evaluation and your informed consent.

2. Eligibility and availability

• You must be 18 or older and physically located in a U.S. state where GetMyIVM and an appropriately licensed physician are available (see "Jurisdictions served" below).
• Medications and services vary by state and by what a physician determines is clinically appropriate for you.
• Some states require a live audio (phone) or video visit before a prescription can be issued. Where that applies, your care will follow that path rather than asynchronous review.
• GetMyIVM does not guarantee that any medication or outcome will be available or appropriate for you.

3. Jurisdictions served

GetMyIVM provides services only to patients who are physically located, at the time of service, in one of the following 44 U.S. jurisdictions: Arizona, Arkansas, California, Colorado, Connecticut, Delaware, District of Columbia, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, Missouri, Montana, Nebraska, Nevada, New Hampshire, New York, North Carolina, North Dakota, Ohio, Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota, Tennessee, Texas, Utah, Vermont, Virginia, West Virginia, Wisconsin, and Wyoming.

In Arkansas, Delaware, District of Columbia, Idaho, Missouri, Rhode Island, and West Virginia, a live audio (phone) visit with the physician is required before a prescription can be issued. In Georgia, Kansas, New York, South Dakota, Vermont, Virginia, and Wisconsin, a live video visit is required.

GetMyIVM does not currently provide services in Alabama, Alaska, Louisiana, Mississippi, New Jersey, New Mexico, and Washington, U.S. territories (including Puerto Rico), or locations outside the United States.

The current list of jurisdictions we serve is always posted at getmyivm.com/jurisdictions and is verified during signup and intake — the Platform confirms your state before any payment or physician review takes place. If service availability changes, we update that page and this section.

4. Payment and authorization

GetMyIVM is cash-pay. We do not bill insurance, and we do not offer memberships or subscriptions.

• The price shown for each medication is an all-in, per-order price that includes the physician review. There are no recurring charges unless you place a new order.
• When you check out, you authorize your payment method. The charge is captured only after a physician approves your prescription and before it is transmitted to the pharmacy. If a physician determines that a prescription is not appropriate for you, you are not charged.
• By providing a payment method, you confirm that you are authorized to use it.

5. Refunds and account closure

Because compounded medications are prepared specifically for you, once a medication has been dispensed it cannot be returned and is not refundable. If an order cannot be fulfilled after you have been charged, we will refund that order. You may close your account at any time by contacting support@getmyivm.com.

6. Care decisions and AI assistance

A licensed physician makes every final treatment and prescribing decision. GetMyIVM uses software, including artificial-intelligence tools, to organize and summarize intake information, draft communications for physician review, flag items for physician attention, and route work efficiently.

AI tools support the care team; they do not make diagnoses or prescribing decisions and do not replace the independent medical judgment of your physician. You consent to this use of AI as part of your care during intake.

7. Compounded medications

Some medications available through the Platform are compounded preparations, prepared by a licensed compounding pharmacy according to an individual prescription. Compounded medications are not FDA-approved products and have not been evaluated by the FDA for safety, effectiveness, or quality. Your physician will discuss this with you, and you acknowledge it as part of your informed consent.

8. Your responsibilities

• Provide accurate, complete, and current health and identity information, and update us promptly when anything changes.
• Read and respond to in-app messages so your care is not delayed.
• Use medications only as prescribed and follow up as instructed.
• Keep your account credentials confidential; you are responsible for activity under your account.
• Do not use the Platform on behalf of anyone else or provide information that is not your own.

9. Communications consent

Secure in-app messaging is the primary channel for care communications. By creating an account you also agree that we may contact you by email for account, care, order, and service notices. Those emails contain minimal detail and direct you to sign in to view the substance. We do not send text messages.

10. Prohibited uses

• No unlawful, fraudulent, or abusive use of the Platform.
• No attempts to access another user's account or data, to reverse-engineer, scrape, or disrupt the Platform, or to introduce malicious code.
• No reselling, sharing, or commercial exploitation of the Platform or any medication obtained through it.

11. Intellectual property

The Platform, including its software, content, design, and trademarks, is owned by Right To Try LLC or its licensors and is protected by law. You receive a limited, personal, non-transferable, revocable license to use the Platform for your own care. Your health records remain yours as described in our Notice of Privacy Practices.

12. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, RIGHT TO TRY LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

GetMyIVM does not warrant that the Platform will be uninterrupted, error-free, or secure, or that any particular health outcome will be achieved. This disclaimer does not limit the professional responsibility of the physicians who provide your care.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RIGHT TO TRY LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM, EVEN IF RIGHT TO TRY LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Right To Try LLC's total aggregate liability for any claim relating to the Platform is limited to the greater of (a) one hundred U.S. dollars ($100) or (b) the total amounts you paid GetMyIVM in the twelve (12) months before the event giving rise to the claim.

This limitation does not apply to liability that cannot be limited under applicable law, including liability for professional negligence (medical malpractice), gross negligence, or willful misconduct, or for personal injury.

14. Indemnification

You agree to indemnify and hold Right To Try LLC harmless from claims, losses, and expenses arising out of your misuse of the Platform, your violation of these Terms or law, or information you provide that is inaccurate or not your own.

15. Dispute resolution; arbitration; class-action waiver

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.

Except where prohibited by law, you and Right To Try LLC agree that any dispute relating to these Terms or the Platform will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You and Right To Try LLC waive the right to a jury trial and the right to participate in a class or representative action.

This arbitration agreement is governed by the Federal Arbitration Act. You may opt out within 30 days of first accepting these Terms by emailing support@getmyivm.com. Claims that may be brought in small-claims court may be heard there. Any claim not subject to arbitration will be brought exclusively in the state or federal courts located in the state in which Right To Try LLC is organized.

16. Governing law

These Terms are governed by the laws of the state in which Right To Try LLC is organized, without regard to conflict-of-laws principles, except where a patient's home-state consumer-protection or telehealth law applies.

17. Changes, termination, and contact

We may modify these Terms; if we make a material change we will post the updated effective date and, where required, notify you. Continued use after changes take effect means you accept them. We may suspend or terminate Platform access for conduct that violates these Terms or law, or to protect patient safety.
